WHO IS THE MOTHER?

Postby charles brough » Mon Jun 25, 2007 11:10 am

Jane's female fetus has aborted and it is decided she can never become pregnant again. She and her husband want their child anyway and have the money to do it. Specialists remove egg cells from the fetus, fertilize them by the husband and impregnate a surrogate mother with the fertilized eggs. It grows full term and a healthy baby is born.

Who is the mother?

It depends upon the legal system involved. Many systems determine parenthood genetically, so the surrogate would not be, but in some systems the surrogate is granted certain quasi-parental rights anyway.

I think Tarzan should have say...

But really, I would have to say both females, one provides genes, but would not the other provide antibodies, and other life giving nutrients that would affect the final result?

Your question needs to be more specific.
Who is the biological mother?
Who is the birth mother?
Who is the foster mother, which could be a relative?

In each of these cases, the answer is different.
