Terminology Question: Flowers, Seeds, and Cannabis.I am working on a brief for a law school exercise regarding the interpretation of a statute. The statute criminalizes the possession of “leaves, stems or flowers of the plant Cannabis family Moraceae”. The defendant was arrested on an unrelated charge and Cannabis seeds were found in his car, he was charged under the standard mentioned above.
The relevant legal question is whether or not a seed is included in the phrase above. One possibility is that a seed might be part of a flower. My question for the board is if the claim “A Cannabis seed is part of a Cannabis flower” is plausible. There isn’t any case law on this point, nor is there a statutory definition clarifying what any of those component terms mean within the context of the law, so the question turns on the ordinary botanical meaning of terms like ‘seed’ and ‘flower’. So that’s the question. For a Cannabis plant, is a seed part of a flower? Is the answer yes or no, and is the answer clear or debatable? I have no idea. Thanks for any help you can offer. -G
like a nutWell, my opinion is that seeds - in one's sense - are not a part of flower. In fact, seeds are riped just after the flower fade. If you reap a herb while flowering, its seeds will not be able to grow up. But this is very speculative theme
