plasmid extraction on 1.5% agarose gel

So I have two bands, the smaller that is around 8-9kb based on the marker ( my plasmids should be 8-9 kb), what is the upper band? Also I have three plasmids and I did this in a set of four replicates

NOTES: bottom is RNA, I didn't have RNAase. First four are should be 7.5KB, last 8 should be 8.8KB like the my markers show.

is the plasmid treated with anything or is it just after isolation?
