#1 he isn't in the fossil record
I have a huge problem with this. Don't we assume many things aren't in the fossil record, that is how we believe in evolution, because we believe there is a lot the fossil record leaves out. This is something I was taught in many intro bio classes, it is difficult to make a fossil.

Maybe I am missing something, maybe we have found fossil records for every single extant organism and that is why they are so bold to use lack of a fossil as dis-proof?

I agree that the fossil record is far from complete, but I would think that we would've discovered something at least similar to indicate the presence of large apes in North America. So far, the only ape fossils ever discovered in the Americas have been humans. Lack of fossils isn't complete disproof but it's cause for skepticism, at least.
